John J. Fausti , Esq., Partner

John J. Fausti has been in private practice in Washington, D.C. for the past eighteen years specializing in government contracts, exports, aviation regulatory matters, and litigation. In July 1992, Mr. Fausti opened his own law firm. Prior to that time, Mr. Fausti was a partner in the Washington, D.C. office of Bogle & Gates where he served as the Client Relations Coordinator of the firm's Government Contracts Practice Group.

Mr. Fausti is experienced in all phases of government contracts from contract formation, including bid protest cases before the General Accounting Office (“GAO”) and the federal courts, negotiation of contract changes, extensions and terminations, negotiation and trial of contract claims, small business size protests, fraud and abuse investigations, audits of multiple award schedule (“MAS”) contracts and debarment proceedings. Mr. Fausti tried and won the largest bid protest in the history of the General Services Administration Board of Contract Appeals. Sterling Federal Systems, Inc., GSBCA No. 10381-P. He also holds the distinction of trying and winning the third largest bid protest at that same forum. Both protests concerned multi-million dollar procurements involving highly complex cost and technical issues.

Mr. Fausti is privileged to represent the National Association of Aircraft & Communication Suppliers ("NAACS"), an organization of one hundred and twenty small businesses representing a broad spectrum of the aviation community. NAACS members include: (i) spare parts distributors who supply aircraft parts to the U.S. and friendly foreign military services; and (ii) companies approved by the Department of Defense ("DoD") and the Federal Aviation Administration ("FAA") to manufacture parts for installation in military and commercial aircraft. Mr. Fausti has worked extensively representing clients before numerous DoD offices (including the Defense Logistics Agency and the Defense Reutilization & Marketing Service); the FAA; the Department of Transportation Inspector General's office; the U.S. Attorney’s offices; the General Services Administration; the State Department's Office of Defense Trade Controls; the U.S. Customs Service; the Small Business Administration; and various other Federal agencies and the U.S. Congress.

Mr. Fausti received his undergraduate degree from Columbia University in 1977 and his law degree from Hofstra University School of Law in 1980 where he served as an editor of the Hofstra Law Review. Following law school, Mr. Fausti served as a judicial clerk to the Hon. Mastin G. White, Trial Judge of the U.S. Court of Claims (now the U.S. Court of Federal Claims), where he assisted at trial and in drafting decisions on government contract claims brought by government contractors. Mr. Fausti is a former National Director of the National Contract Management Association ("NCMA"). He is admitted to practice law in the District of Columbia and the State of New York and is a member of the bars of the U.S. Court of Federal Claims, the U.S. Court of Appeals for the Federal Circuit, the U.S. District Court for the District of Columbia and for the Eastern and Southern Districts of New York. Mr. Fausti is also a member of the ABA's Public Contract Law Section's Bid Protest Committee.

Monica C Parchment, Esq., Of Counsel

Monica C. Parchment joined Fausti & Associates as a senior associate in April 2002. Ms. Parchment specializes in federal and state government contracts law. Prior to accepting a position with Fausti & Associates, Ms. Parchment was an associate with the law firm of Venable, Baetjer, Howard and Civiletti, LLP in the Government Contracts Practice Group.

Ms. Parchment represents government contractors in bid protests before the GAO, federal courts and various agency boards. She also represents clients in pursuing contract disputes against the Government, such as delay, disruption, and wrongful terminations for default claims. In addition, she frequently counsels clients on various matters specifically relating to federal laws such as the Service Contract Act and the Buy American Act, as well as various agency regulations which impact contractor award and performance.

Ms. Parchment also provides contract administration assistance to companies which includes reviewing and analyzing legal and performance terms in federal and state solicitations and related subcontracts and teaming agreements. She also assists in the negotiation of the prime contract and subcontract terms and conditions at the federal, state and local level. Ms. Parchment’s responsibilities also include supporting the firm’s Compliance practice which involves, amongst other things, providing advice to various corporations regarding the many legal issues that impact a company’s business operations, the best methods of ensuring compliance with applicable laws and regulations, and making necessary recommendations for improvement of corporate quality control systems.

As the Continuing Legal Education ("CLE") Coordinator for the National Bar Association’s Small Business Development Committee, Ms. Parchment remains current on legal and business topics of interest to small businesses and legal practitioners. In addition, in this capacity, she is also extensively involved in selecting and organizing the small business CLE programs that will be hosted by the National Bar Association at its yearly Convention.

Ms. Parchment is also familiar with federal and state small business and socioeconomic programs and has frequently provided counseling and assistance to small businesses in gaining entrance into these programs and dealing with the myriad of procurement regulations that impact their contract performance. She also supports Fausti & Associates in its representation of the National Association of Aircraft & Communication Suppliers ("NAACS").

Ms. Parchment received her undergraduate degree from Mount Saint Mary’s College in 1993 and her law degree from the George Washington University in 1996. She is also a member of the American Bar Association’s Section on Public Contract Law, the Federal Bar Association, and the National Bar Association. She is admitted to practice law in the District of Columbia and the State of Virginia.

Mr. Odyssey E. Gray, III

Odyssey E. Gray, III has been with Fausti & Associates since September 1995. Mr. Gray oversees the administrative duties and accounting of the office, drafts Freedom of Information Act (“FOIA”) requests and correspondence. Mr. Gray has become intimately familiar with the clientele, including the National Association of Aircraft and Communication Suppliers (“NAACS”), an organization of one hundred and twenty small businesses representing a broad spectrum of the aviation community. Mr. Gray has attended NAACS and government-agency sponsored conferences as well as various congressional hearings and meetings on Capital Hill with congressional persons. Mr. Gray is a certified lobbyist with the U.S. House of Representatives.

Mr. Gray majored in psychology at Ohio State University and is pursuing a degree in psychology at the University of Maryland.
